The terms and conditions between Emko Elektronik A.Ş (will be reffered as “Emko”) and the person (will be reffered as “User ”) whom benefit from the Emko’s products, software, services and web sites (collectively Emko's “Services”) setted out in this document. These are reffered to below as “ User Terms ”. • Emko will supply it's Services as agreed in User Terms. In order to use the Services, Users must firstly agree to the User Terms. Person whom do not accept the User Terms may not use the Services. By using this Services, you accept all the terms. • Users by no matter what it means may not use this Services to violate the rights of public, against public morality, for common nuisance, against the legal law terms or by means of harming the rights, property or safety of Emko. User may not present this Service to third parties and can not use for commercial purposes such as reproducing, dublicating, copying, renting or selling. Also, User agrees not to engage in any activity that interferes with or disturbs (such as spam, virus, trojan etc) the Services or the servers and networks which are connected to Services. • Emko is not liable for any loss or damage which may be incurred by the User. The User who do not abide a rule or rules of User Terms is under all liablity of penal act. Besides, Emko has the rights to claim for indemnity from User for violation of User Terms if the case passes to the court. • Emko has the rights to stop the Service continuously or temporarily, to end a membership of a User, to delete the files or information belongs to the User. The User understands and agrees to this term at the begining. On this matter, Emko has no liabilities. • In order to access certain Services, you may be required to provide personal information (such as contact details) as a part of registration process. Emko has no liablity if User informations has accessed by unauthorized people and also has no liablity if there is any harm to User's software or information. User accepts not to claim for any indemnity in case of any harm by the use of Emko's Services. • Users also accepts not to access other internet user's computers, softwares or datas with out authorization. Otherwise, the User has all the liablity for penal acts against the court. • Users solely responsible for the use of the password provided by Emko. User has no right to give password to anybody else or other companies. Accordingly, User agree to be solely responsible to Emko for all activities that occur under his/her account. Emko reserves the rights to claim for any indemnity for the problems constituted or any blame by third parties or authorities because the use of unauthorized use. • The licenced softwares, can only be used by abiding the copyright obligations stated in Law no.5846 on Intellectual and Artistic Works. This softwares, can not be copied or dublicated without the permission of copyright holder. Otherwise, the User has all the liablity. Furthermore, the software which given to the User by Emko, can not be used by any other purposes, the User has no right to reproduce, dublicate, copy for free, rent or sell it. Emko holds the proprietorship of the softwares given to User by Emko with or without any fee. • Users agrees to obey Intellectual and Artistic Rules, Trademark Rules, Turkish Commercial Code, The Code of Laws for Patent Rights, Turkish Penal Code and all other related legal laws and regulations. User agrees and subscribes absolutely not to violate this terms at the begining. Otherwise, all the legal and criminal liablity affects only the User. • Emko reserves the rights to supply all the informations to public authorities related if Emko ascertain that User uses the Service inviolation of User Terms or laws or if there is a request from competent authorities. Also, in similar situations Emko has rights to take measures prescribed at the User Terms item 3 and 4. • In case cut of Service because of the technical faults from electrical and mains, sattellite and other networks, communication infrastructure system, server or any device, Emko will try to overcome the problems with its technical people on duty. But, because of the cut of service and/or loss of file or information during this time Emko has no responsibility. Therefore, User accepts and assures not to claim for any indemnity from Emko. • Some writings on website, ideas are user's own opinions (such as Online Chat). This ideas and opinions has no relation with Emko. Emko has no liablity for any harm or aspersion given to the third parties by Emko's Users, users has all the liablity. • Users accepts all supplied information (such as his/her contact details) during registeration process to Emko's system is correct on observance of the laws. Therefore, Users also declare and subscribes absolutely to retrieve all the loss of Emko immediately. • Emko reserves the rights ( but shall have no obligation ) to record all the movements and acts of the User on Internet during the use of Service.
